Emergency Exits, (2) Door Survey
Dear Ms.
Gonzaba:
I thought it would be appropriate to respond
to your email response (ref. 3) to my original email (ref. 2) formally. The
text of our emails is attached herein.
It is Lakewood management that told us
recently that Lakewood has a letter approving conversion of two of the
garage/interior doors to emergency exits by removing the locking devices and so
I believe it is Lakewood, not the city, who is obligated to the tenants to back
up that claim.
Security and safety are not necessarily
mutually exclusive. Emergency exits would have been required as part of the
original building design. It may be that at some later time additional
emergency exits were legally required to satisfy some retroactive new
requirement. However, I believe Lakewood is obligated to either demonstrate
that additional emergency exits were legally required in the two areas involved
and also to demonstrate that it was not possible to provide such exits in some
way that would not violate the code requirements for ingress/egress security or
restore the security of those two doors. If you would like to inspect the
locations in question with us we would be happy to do so for discussion
purposes.
We have previously provided (ref. 1) your
office with a detailed survey of the security of the exterior doors. In that
survey, we reported to you that the door at the front of the "F"
building at grade had rusted hinges and that that door would rest open.
Yesterday returning home I noticed that door resting open. Again this morning I
notice that door resting open so Mona Cereghino and I photographed it (see
photo below) along with a newspaper to prove that the photograph was taken no
earlier than today, some 35 days after the problem was disclosed to Lakewood in
our letter (ref. 1). I cannot imagine how Lakewood management could overlook
such an obvious invitation to criminals to enter the property. Do the owners
really want the property to appear this way to prospective new residents? I am
disappointed that Lakewood has apparently not taken advantage of the efforts Mona
Cereghino and I previous made, via the survey, to help Lakewood management accomplish
their own responsibilities to maintain the property to minimum safety standards.
We have received no response to our previous letter (ref. 1) noting the
apparent failure of Lakewood to keep its prior commitments to maintain a
numbering system for the doors and perform routine inspection and repair of
doors failing to meet code security requirements.

Just a reminder that LTA is
still waiting for Lakewood to produce the letter your maintenance manager
claimed you have that documents SFDBI and SFFD approved the conversion of two
garage/lobby doors into emergency exits.
